Resolution 45/95 of December 14, 1990 adopted by the UN General Assembly
On June 26, 1985 under the patronage of the United Nations Human Rights Commission a draft guidelines concerning regulations pertaining to electronic data banks containing amongst others personal data were prepared. This paper was adopted in 1988 and declared on December 14, 1990 as a resolution containing guidelines for the regulation of computerised personal data files. The above guidelines do not have binding force. They are only recommendations pertaining to guarantees which should be provided for in national legislation in the field of computerised processing of personal data. This resolution is based on several simple principles (lawfulness and fairness, accuracy, purpose-specification, interested-person access, non-discrimination and security) which should be introduced into national legislation.
